1 – General Provisions :
1.1 Nighty.ma is powered NEW WAVE MEDIA a Moroccan company, registered in the Commercial Registry of Rabat under the number RC: 171551 , IF : 53966643, with its registered office located at Building N°30, FLAT N° 8, MOULAY AHMED LOUKILI HASSAN RABAT.
1.2 Acceptance The Buyer declares to have read the General Terms of Sale before placing an order and has accepted them without reservation.
1.3 Purpose Contractual provisions.
1.4 Contractual Provisions The nullity of a contractual clause in the General Terms of Sale shall not result in the nullity of the entirety of these terms.
1.5 Modification of the General Terms of Sale Nighty.ma reserves the right to modify these General Terms of Sale at any time. The applicable General Terms of Sale are those in force on the date of the order placed by the Member.
2 – Orders 2.1 Final Nature of the Order Orders placed on the website constitute a firm and final commitment, and after confirmation of such order by Nighty.ma through email to the email address provided by the member.
2.2 Order Modification Since orders are final and irrevocable, any request for modification made by the Member is subject to Nighty.ma’s acceptance.
2.3 Validity of the Order Nighty.ma reserves the right to refuse any order for legitimate reasons, especially when the quantities ordered are abnormally high compared to the quantities usually ordered by Members as consumers.
3 – Ticket Price The price is expressed in DIRHAMS. The price indicated in the order confirmation is the final price, including all taxes.
4 – Delivery of Tickets or Vouchers The delivery of the ticket or voucher is done electronically, and it is printable at home, provided with a unique barcode or QR code. It is not possible to be admitted to the event multiple times with the same ticket. Reproduction of tickets is prohibited and will not provide any advantage. Only the first person presenting the ticket will be allowed to attend the event.
Your printable tickets are available at all times until the event date on the website under the “My Orders” section.
The ticket buyer takes all necessary precautions to keep their password secret and to prevent unauthorized use or breach.
In any case, Nighty.ma cannot be held responsible for the non-delivery of the ticket to the Member if such non-delivery is due to incorrect information provided by the Member.
When the ticket is sent to the address indicated by the Member, it is the Member’s responsibility to check the nature of the ticket sent and, in case of error, to make reservations, possibly refuse the ticket or voucher, and notify Nighty.ma within 48 hours.
The refund of payments for canceled events or deals is automatically made to the ticket buyer through a credit on the credit card provided during the ordering process.
5 – Cancellation, Refund, Use Tickets for shows are not subject to a right of withdrawal, and all purchases are final.
A show ticket cannot be refunded, even in case of loss or theft, except in the event of show cancellation. In case of show cancellation, only the ticket price will be refunded. This refund will be made only to the original purchaser upon presentation of the ticket.
No duplicate ticket will be issued, even in case of loss or theft.
No refunds will be made beyond 30 days after the originally scheduled event date.
Upon entry to the event venue, a valid, photo identification may be required, and it must match the name on the ticket.
In case of an event cancellation or a change in the date, time, or venue of a show for which you have purchased tickets, you agree that Nighty.ma to the extent possible, when informed by the organizer, may use the contact information you provided during the reservation to keep you informed of the next steps.
We recommend that you verify 24 hours before the event that it is still scheduled without any changes.
In the case of a refund, fees will be deducted from the purchase amount to cover transaction costs.
The refund processing time is 4 to 8 weeks from the date the request is received.
In the event of a show rescheduling or change in programming, only a balance transfer is valid upon customer request, and no refund will be provided in this case.
In cases of force majeure, such as an earthquake, storm, floods, or any other unforeseeable and unavoidable event, no refund will be issued in accordance with our refund policy.
6 – Value The value of vouchers is the one in effect on the day of the order confirmation by the Member, as mentioned in the article above. Nighty.ma commits to apply this value to any order placed during the advertising period on the website.
Any sale of vouchers for a fee is strictly prohibited.
7 – Deposit of Voucher Value 7.1 Due Date The deposit of the value of the ticket or voucher is made upon confirmation of the order by Nighty.ma
7.2 Payment Methods To settle your order, you can choose a payment method among those offered by Nighty.ma on the payment page.
In this case, the debit transaction from your account is processed on the day following the delivery confirmation date.
Your online payments are secured by the Interbank Monetization Center (CMI), which offers a fully secure payment service.
The Consumer guarantees Nighty.ma that they have the necessary authorizations to use the chosen payment method when validating the order.
In case of payment by credit card, the provisions regarding the fraudulent use of the payment method, as stipulated in the agreements between the Consumer and the card issuer and between Nighty.ma and its banking institution, apply.
8 – Dispute Resolution, Applicable Law, and Jurisdiction 8.1 Complaint Any complaint should be addressed to Nighty.ma’s consumer service. Contact us at ticket@nighty.ma
8.2 Applicable Law and Competent Jurisdiction The General Sales Conditions are governed by Moroccan law. Any dispute related to the order or these General Terms of Sale will be submitted to the competent court.
9 – Confidentiality and Use of Data NEW WAVE MEDIA a limited liability company with a capital of 100000 DH with its registered office at Building N°30, FLAT N° 8, MOULAY AHMED LOUKILI HASSAN RABAT.
The information collected on the website Nighty.ma is subject to processing for the following purposes:
Associating a buyer with a purchased ticket
Identifying a specific buyer for refund or cancellation requests
Monitoring the evolution of ticket sales volumes
The recipients of the data are :
Service financial department .
Service marketing department .
Direction générale department .
